From October 1 to 4, 2026, the IFPPC brought together professionals specializing in the restructuring of financially distressed businesses for its 42nd National Congress in Porto.

The study day held on Friday, October 2, organized by the IFPPC under the academic direction of Marie-Hélène MONSERIE-BON, Professor at Paris-Panthéon-Assas University, and Adrien BEZERT, Professor at Université Bourgogne Europe, focused on a topic at the heart of current challenges facing financially distressed businesses:

“Post-Petition Debt: What Comes Next? The Cost of Continuing Business Operations: Practices, Treatment, and Liability”

On this occasion, Claire GAMAIN Partner at Hoche Avocats, participated in the first two panel discussions, which addressed the following topics:

Panel 1 – The Events Giving Rise to Post-Petition Debt

The company’s financial situation and the commencement of insolvency proceedings; the appropriateness of judicial reorganization; and economic, practical, and legal criteria.

Panel 2 – The Enforceability of Post-Petition Debt

Authority to incur debt and the validity of claims; the benefit derived from claims; claims arising from the ordinary course of business; the impact of converting insolvency proceedings; and the consequences of failing to pay post-petition debts.
