France : The Minister of Justice, has presented an order adapting the rules relating to business difficulties to the consequences of the covid-19 epidemic.

This order temporarily adapts the rules relating to business difficulties to take into account the consequences of the evolution of the health crisis. It complements Order no. 2020-596 of May 20, 2020 adapting the rules relating to the difficulties of companies and farms to the consequences of the covid-19 epidemic, which is still in force.

It encourages the use of preventive procedures by allowing the duration of conciliation procedures to be extended from five to ten months. The ordinance also allows the association for the management of the employees’ claims guarantee scheme (AGS) to take over wage claims more quickly. It relaxes the terms of communication between the main players in preventive and collective proceedings and the court registry or the jurisdictional bodies involved in the proceedings.

All of these measures will be applicable until December 31, 2021 inclusive.
